These General Terms and Conditions of Sale apply to the sale of items between Belatika and the Buyer.
The Terms and Conditions are accessible at any time on this Shop.
The Buyer agrees to have read the Terms and Conditions and to accept them without reservation by placing an order.
All or part of these Terms and Conditions may be modified or supplemented at any time without prior notice. In such cases, the applicable terms and conditions will be those in effect on the date the Buyer places the order.
The Seller reserves the right to modify any presentation of items in the Store without prior notice.
The texts and photographs illustrating the items in the Shop do not constitute a contractual document.
Since each screen is calibrated differently by its user, there may be color variations of an item between the photograph shown on the online store and the delivered item which cannot in any way justify a cancellation of the order or a refund of the item ordered.

All rights reserved. Reproduction of the content of the Shop, in whole or in part, is prohibited without the Seller's written permission.
All material contained on the Store (photos, texts, images, logos, product names or trademarks mentioned…) is the property of their respective owners.
Any reproduction, even partial, is prohibited.
Disputes:
These online sales terms and conditions are governed by French law.
In the event of a dispute, only the Court is recognized as having jurisdiction.
Payments:
Payment is due in full upon final confirmation of the order by the Buyer.
The order is definitively confirmed upon receipt of full payment.
The Seller reserves the right to refuse any order for legitimate reasons.
The Seller retains ownership of the items until full payment of the order.
All data provided and the recorded confirmation will serve as proof of the transaction. Confirmation and payment of the order will constitute signature and acceptance of the transactions carried out.
Selling price:
The prices shown on the online store are inclusive of VAT and are in euros.
Shipping costs are included in the sale price.
Prices may be increased depending on the Buyer's specific customization requests. The Buyer will then be informed of the new price and must confirm their agreement.
The Seller reserves the right to modify its prices at any time, it being understood however that the price indicated to the Buyer at the time of order confirmation will be the only applicable price.
Accepted payment methods:
If payment is made by check, it must be issued by a bank located in metropolitan France or Monaco.
Any order paid by check, bank transfer or money order will only be processed upon receipt of the payment method.
Shipping times will be recalculated from the date of receipt of payment.
Checks are cashed upon order confirmation.
The consumer guarantees that they have the necessary authorizations to use the payment method chosen by them when validating the order form.
If the check or transfer is not received within 15 days of placing the order, the order will be considered automatically cancelled.

Invoices will not be provided in paper format but will be available in your personal space and downloadable.
Deliveries:
Delivery will be made by La Poste via tracked letter (Compensation in case of loss or damage according to the rates in force issued by La Poste).
The customer remains liable for any taxes or customs fees that may be applied upon importation of the products into their country of residence.
Shipping times:
The Seller undertakes to ship any order within 1 business day (after receipt of payment).
Delivery times provided by La Poste services are given to the Buyer for informational purposes only and do not in any way bind the Seller to a delivery time obligation.
The Seller shall under no circumstances be held responsible for the consequences due to any delay in delivery, particularly during the Christmas period.
The Seller is released from its obligation to deliver in the event of:
- occurrence of a case of force majeure such as war, riot, fire, strikes, accidents and the impossibility of being supplied, particularly in the event of severe weather (heavy snowfall, floods, etc.).
- Failure by the Buyer to fulfill one of its obligations: payment of the price, inaccuracy of information provided by the Buyer (such as the delivery address and/or an omission…).
Delivery address:
Belatika ships its orders to the delivery address provided by the customer on the website https://belatika.com (the address registered on the paypal website will not be taken into account).
Unless otherwise specified to the seller at the time of ordering and BEFORE confirmation of the order by the seller, and regardless of the payment method used by the buyer, the order will be sent to the address shown on the order form.
In the event of non-delivery of the package due to failure to transmit the correct postal address, and after return to the seller the package will be reshipped to the buyer at their expense and after confirmation of the correct address.
The return shipping costs will be paid through the website.
No refund requests will be accepted.
In the event of an error in transcribing the sending address by the seller, or in the event of an error solely due to the seller which led to the non-receipt of the package by the buyer and AFTER the return of the package, the seller undertakes to either reship the package at its exclusive expense, or to reimburse the buyer (purchase price + shipping costs).
Refunds and exchanges:
Complaints:
The Buyer is required to check the condition of the products upon receipt.
Any package that is totally or partially damaged and/or opened must be refused.
Furthermore, he must inform the Seller within two working days of receiving the package of any damage and/or any total or partial loss of the order, attaching all the necessary supporting documents for his claim.
No claims will be accepted if these formalities are not respected.
Right of withdrawal:
The Buyer has a right of withdrawal of 14 days from the date on which he/she took physical possession of the goods purchased.
Items delivered in France may be eligible for a refund, except those that have been personalized at the Buyer's request in accordance with Article L 21-20-2 of the Consumer Code.
The item must be intact, complete, in new condition and in its original packaging.
The Buyer must notify the Seller of their intention to withdraw by means of an "unambiguous statement" or by using the online form.
Gift vouchers:
- usable only once
- If the purchase is less than the value of the gift certificate, no refund will be issued.
- it cannot be combined
- cannot be used during sales or any other promotion
Custom orders:
Custom orders have a slightly longer shipping time than other items. This is due to the time required to prepare your jewelry and/or the delivery of certain raw materials.
You will be notified by email or Facebook message about the progress of your order.
Personalized items are final sale, non-returnable, non-exchangeable, and cannot be discounted or sold out. Gift certificates can be used towards a personalized jewelry order.
Refunds:
Subject to compliance with the above-mentioned conditions, the seller will refund all payments received by the Buyer upon return of the order.
The refund will be made either by bank transfer or by Paypal.
The Seller will only reimburse the Buyer once the returned items have been received.
The Buyer must return the product(s) no later than 14 days from the date on which they notified the seller of their decision to withdraw. Return shipping costs are the responsibility of the Buyer. The product(s) must be returned in a manner that provides maximum protection*. Any product returned and received damaged or broken by the seller will not be refunded.
After receipt, the Seller has 4 days to check the condition of the product before proceeding with the refund.

The goodies (gifts):
Goodies cannot be returned, exchanged, or refunded.
Belatika reserves the right not to offer any gifts on its website.
No claim will be considered if a goody is not offered on the site and if it is not present in the order.
The Treat:
Composition of the candy: sugar, fructose syrup, citric acid, natural colors, flavorings.
Acceptance of these general terms and conditions of sale confirms that the buyer has taken into account the composition of the sweets and is therefore solely responsible in case of allergy and cannot claim any compensation from Belatika.
Belatika reserves the right not to include a treat in every order. If a treat is not included, the buyer cannot make any claim against Belatika.
Gift card:
Belatika gift vouchers are valid for one year, and only valid on the belatika.com website.
Belatika gift vouchers are not nominative, and can be used by a single beneficiary in one or more installments.
The gift certificate can be used to pay for an order of an amount less than, greater than or equal to the value of the certificate.
If the order amount is less than the value of the gift certificate, the balance of your certificate can be used on a future order.
Each gift voucher displays a unique code. This code must be entered in the "gift card" field located on the "shopping cart" page.
If the order total exceeds the value of the gift certificate, you can pay the difference using the payment methods available on the website: Credit card, Check, Bank transfer, Paypal
Restrictions:
Belatika gift vouchers cannot be sold, exchanged or refunded.
Each gift voucher is valid for one year from the date of purchase. After that date, the voucher is no longer valid.
Loss:
The risk of loss and title to gift certificates are transferred to the purchaser or designated recipient when the gift certificate is sent by email.
We will not be held responsible if a Gift Certificate is lost, stolen, destroyed or used without your authorization.
Fraud:
Gift certificates have a unique number and cannot be reproduced. Any copying or attempted fraudulent use will result in the cancellation of the order. Belatika reserves the right to take legal action against fraudsters.

When you purchase, receive, or use a Gift Certificate, you agree to these Gift Certificate Terms and Conditions.
